Cook and Eat Along Class Agreement

Reservation Policy:

  • Cook Along and cooking class Terms and Conditions constitute a legal and binding contract between Comfort N Spice, LLC (CNS) and you. Your signature on this document signifies that you are agreeing to be bound by all provisions in this document at the time of your acceptance. For custom classes with your participants/group, you are representing and signing for your participants/group.
  • Payment in full is required at time of acceptance of this agreement. We accept credit cards (Swipe), cash, direct pay transfers, or money orders. Zelle, Apple Pay, People Pay, PayPal, Cash App, or similar payments should be directed to [email protected]. If you use a payment option that charges a usage fee, that fee will be added to your payment amount/invoice.

  • Once this agreement has been executed and CNS receives payment in full, CNS will provide recipes and/or handouts for the Cook Along. It is the client’s responsibility to acknowledge or inform CNS if the class material is not received.
  • In the event that Comfort ‘N Spice must seek legal remedies to complete execution of this contract, the client agrees to pay all reasonable attorney fees.
  • Please ask participants to arrive on time for the Cook Along.   We will start on time.

Cancellation Policy

  • We will issue refunds for cancellations received in writing at least 2 weeks or (14) business days prior to the event.  
  • CNS shall have no responsibility or liability for failure to supply any services when prevented from doing so by strikes, accidents, illness, or any cause beyond Comfort N Spice’s control, or by orders of any governmental authority, except to return said retainer fee within sixty (60) days.

 

Consent Form, Assumption of Risk, Waiver and Release

  • Cook Alongs or classes with CNS are for the purpose of learning to cook and/or healthier methods to prepare food. With all cooking activities, certain risks and dangers arise, not all of which can be described herein, but may include, without limitation, cuts, scrapes, scratches, puncture wounds, thermal burns, chemical burns, scalds, injuries from using cooking equipment and instruments, eye injuries or irritation, skin irritations, allergic reactions, food poisoning, slips, falls, and choking.  It is the responsibility of the client/participants to accept the aforementioned risks.  Acceptance of this agreement signifies that the client and all participants related to the client understand and appreciate the inherent risks and the types of injuries that may occur as a result of participation.  All participants assert that participation in CNS classes or activities is voluntary and knowingly assume all risks associated therewith.
  • All participants are ultimately responsible for maintaining the quality of the food they prepare, cook and eat during any class or after any class.  Participants are solely responsible for protecting themselves against allergic reactions pertaining to food and food safety issues (e.g., cross-contamination, improper food temperature, etc.)
  • Further, in consideration of each participant’s ability to participate in a class or activity, he/she/they do hereby waive, release, indemnify, and shall hold harmless CNS and its owners, members, managers, officers, directors, chefs, employees, attorneys, agents, and assigns (collectively, the “Released Parties”), from and against any and all demands, claims, losses, injury, damages, liability, attorney fees, costs, and/or expenses of litigation, in law or in equity, whether known or unknown, that have arisen or may arise from participation in or attendance at any classes or activities provided by CNS, or from the use of any recipe, skill, technique, or method learned from CNS or in any of CNS’s classes or activities.  Further, the participant promises not to sue any of the Released Parties for such demands, claims, or liability.

 

Recipes

  • Recipes and/or handouts with informative tips etc. will be given to participants for the food items produced.  CNS hopes that participants will use these recipes for personal use.  However, these recipes are and remain the intellectual property of CNS. Recipes will be provided ~7-10 days prior to the class.
  • Participants may not use CNS’s recipes for any commercial use.  CNS reserves the right to take judicial action to prevent any unauthorized use of CNS’s recipes or other intellectual property.

 

Photographs, Videos, and Recordings

  • For privacy purposes, and to protect CNS’s intellectual property, clients/participants may not make video, audio, or any other recordings of any of CNS’s classes or activities without first obtaining CNS’s prior written consent.  You may take photographs of your participation in CNS’s classes and activities for personal use; provided, however, that you obtain consent of any other participants or any chef or employee or contracted worker of CNS included in such photographs.
  • Unless you provide CNS with written notice to the contrary, prior to your participation in any CNS class or activity, you agree that CNS may take photographs or make video, audio, or other recordings of such class or activity, and hereby grant CNS permission to use such photographs or recordings, along with your image, voice, performance, or likeness, on CNS’s website, for marketing and advertising purposes, in connection with media releases, for informational purposes, and for any other commercial purpose reasonably related to CNS’s business as determined by CNS.

 

Confidentiality

CNS shall strive to preserve the confidentiality of any information you provide to CNS, and will not sell or give your information to any third party.
